Terms of service
These Terms of Service govern your use of myheightened.com and any purchase you make from it. The site is operated by Heightened ("Heightened", "we", "us"), 8 The Green, STE R, Dover, DE 19901, United States. By browsing the site or placing an order you agree to these terms.
1. Who can order
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that the payment method you use belongs to you and that the information you give us is accurate.
2. Products
Heightened sells cosmetic body-care tools and preparations. Product photography is representative; natural materials such as wood and copper vary in grain and tone between units, and colours can appear differently between screens.
We describe the effects our customers report on the appearance and feel of skin. Our products are cosmetic. They are not medicines or medical devices, they are not intended to diagnose, treat, cure or prevent any condition, and nothing on this site is medical advice. Individual results vary and are not guaranteed. If you have a skin condition, are pregnant, or have any concern about whether the products suit you, speak to a qualified healthcare professional before use.
Follow the usage directions supplied with the products. Do not use the brush on broken, irritated, sunburnt or recently shaved skin, over varicose veins, or on the face unless using a brush intended for facial use.
3. Prices and availability
Prices are shown in the currency selected on the site and may change at any time before you place an order. We try to keep the site accurate, but errors happen. If we discover a material error in the price or description of something you have ordered, we will contact you before dispatch and give you the choice of continuing at the correct price or cancelling for a full refund.
Advertised discounts and multi-buy savings are applied at checkout. Where a promotional price, discount code or automatic discount is shown, the amount charged at checkout is the amount you pay.
4. Orders
Your order is an offer to buy. A contract is formed when we send you a dispatch confirmation, not when you receive an order confirmation. We may decline or cancel an order — for example where an item is out of stock, where we suspect fraud, or where an order appears to be for resale. If we cancel, we refund you in full.
5. Subscriptions and recurring payments
Some Heightened products are offered on a subscription. Please read this section carefully.
- When you buy a subscription you authorise us to charge your payment method automatically on a recurring basis at the interval shown at checkout, until you cancel.
- The price, the billing interval and the amount of the first charge are shown on the product page and at checkout before you pay. Any introductory or first-order price applies to that first order only; renewals are charged at the standard subscription rate shown at checkout.
- Subscriptions continue indefinitely until cancelled. There is no minimum term and no cancellation fee.
- You may cancel, skip or reschedule at any time using the management link in your order confirmation email, or by emailing us. Cancel before your renewal date and you will not be charged again.
- If we change subscription pricing, we will tell you by email before the change takes effect, with enough notice for you to cancel.
6. Payment
Payments are processed by Shopify and its payment providers. We do not store your full card details. You are responsible for any bank or card charges, including foreign transaction fees, applied by your own provider.
7. Shipping and delivery
We currently ship to the United States, the United Kingdom and Australia. Delivery estimates given on the site are estimates, not guarantees, and do not account for delays outside our control such as carrier backlogs, customs or severe weather.
Risk in the goods passes to you on delivery. Where duties or import taxes apply to your destination, responsibility for them is as stated at checkout.
8. Returns and refunds
Every order is covered by our 60-day money-back guarantee, and no return is required. The full terms are set out in our Refund Policy, which forms part of these terms.
9. Reviews and customer content
If you send us a review, photograph or other content, you keep ownership of it and grant us a non-exclusive, royalty-free, worldwide licence to display and use it in connection with Heightened, including in marketing. You confirm the content is your own, is accurate, and does not infringe anyone else's rights. We may decline or remove content at our discretion.
Testimonials shown on this site are from real customers and describe their individual experience. They are not a promise that you will get the same result.
10. Intellectual property
The Heightened name, logo, site design, photography and written content are owned by us or licensed to us, and are protected by copyright and trade mark law. You may not copy, reproduce or use them commercially without our written permission.
11. Acceptable use
Do not use this site to break the law, to interfere with its operation or security, to scrape or harvest data by automated means, or to resell our products without authorisation. We may suspend access where we reasonably believe any of these are happening.
12. Third-party links and services
The site links to and relies on services operated by others, including payment, shipping, analytics and advertising providers. We are not responsible for the content or practices of third-party sites. Your use of them is governed by their own terms.
13. Disclaimers and limitation of liability
The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free.
To the fullest extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profits or lost opportunity.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Nothing here affects your statutory rights as a consumer, including under the UK Consumer Rights Act 2015 and the Australian Consumer Law where those apply to you.
14. Indemnity
You agree to indemnify us against claims and costs arising from your breach of these terms or your misuse of the site.
15. Governing law
These terms are governed by the laws of the State of Delaware, United States, and the courts of Delaware have jurisdiction over any dispute. If you are a consumer resident in the United Kingdom or Australia, this does not deprive you of the protection of the mandatory consumer laws of your own country, or of your right to bring proceedings there.
16. Changes to these terms
We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order.
